Official Rules

  1. NO PURCHASE, PAYMENT OR SALES PRESENTATION NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID OUTSIDE U.S., AND WHERE PROHIBITED BY LAW. SWEEPSTAKES BEGINS 12:00:01 A.M. ET ON 9/1/09 AND ENDS AT 11:59:59 P.M. ET ON 10/31/09 ("PROMOTION PERIOD").
  2. Who May Enter. Sweepstakes only open to legal residents of the 50 United States and the District of Columbia who are of the legal age of majority in their state of residence. The following persons are NOT eligible to participate: employees of the California Table Grape Commission ("Sponsor"), the advertising and promotional agencies of Sponsor (collectively the foregoing shall be referred to as "Promotional Parties") and immediate family members (parent, child, sibling and spouse of each) and household members of such employees. Subject to all federal, state, and local laws and regulations. Void outside the U.S. and where prohibited by law.
  3. How to Enter. During the Promotion Period, go online and complete and submit in full an official entry form at the website, www.grapesfromcalifornia.com. Entry must be filled out completely and accurately with first and last name, age, daytime telephone number (including area code), street address (no PO boxes, please) and e-mail address. Limit of one entry per person/e-mail address. Any form of entry other than that described herein is void. Sponsor is not responsible for any computer or e-mail failures that may result in lost or garbled entries or which affect the administration of the Sweepstakes. All entries become the property of the Sponsor and will not be acknowledged or returned. Promotional Parties are not responsible for incorrect, lost, late, misdirected, damaged, or incomplete entries. Promotional Parties are not responsible for computer system or transmission line errors, software or hardware malfunctions, or other errors, failures, or delays in transmission that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from downloading or entering any part of this Sweepstakes. Entries will be deemed to have been submitted by the Authorized Account Holder of the e-mail address submitted at time of entry. The "Authorized Account Holder" is the natural person who is assigned the e-mail address by an Internet access provider, online service provider, or other organization (such as a business or educational institution) that is responsible for assigning the e-mail address for the domain associated with the submitted e-mail address. In the event of a dispute over the ownership of an e-mail address, the Authorized Account Holder of the designated e-mail address will be considered the potential winner of any prize. Multiple participants are not permitted to share the same e-mail address. Any attempt by any participant to obtain more than the stated number of plays by using multiple/different e-mail addresses, identities, registrations and logins, or any other methods will void that participant's plays and that participant may be disqualified.
  4. Prize. One (1) Grand Prize: a trip for two (2) to Four Seasons Resort The Biltmore Santa Barbara resort. Prize includes round trip coach class airfare from a major commercial airport near winner's residence to Santa Barbara, CA, three (3) nights’ hotel accommodations [double-occupancy] on Four Seasons Resort The Biltmore Santa Barbara resort property, ground transportation, meals, and a spa package for winner and guest. The winner will also participate in Fresh Start for the New Year activities with Bob Greene and Janis Jibrin, including a personal training session and nutrition consultation. Winner is responsible for all travel-related expenses not listed above, including gratuities, airline baggage fees and incidental room charges. Winner is responsible for obtaining all necessary travel documents, and Sponsor is not responsible for delays in obtaining such documents. Winner must be available on the dates of November 12–15, 2009. If winner is not available for that time period winner must alert Sponsor two (2) weeks in advance and will not be compensated if winner cannot be present during time period. A new winner will be chosen if first selection winner cannot attend during the two (2) days of package. Winner must act in a responsible manner and comply with ground rules for conduct at the resort and/or property; rules will be available/posted, on-site, upon arrival. If winner violates any of the ground rules, breaks any laws, or endangers his/her own safety or the safety of any other person at the resort and/or property, as determined by Sponsor or its representatives at their sole discretion, winner will not be permitted to remain. No compensation will be given to winner if winner is required to leave early.

    The approximate retail value of the grand prize is $4,000. The actual value may vary depending on point of departure and airfare fluctuations; difference between estimated value and actual value, if any, will not be awarded.
  5. Drawing and Verification of Potential Winner's Entry. Potential winner will be selected in a random drawing from among all eligible entries received, on or about November 3, 2009 at the offices of the Administrator in Dallas, TX, USA. Potential winner need not be present at the time of the drawings. Odds of winning depend upon the total number of eligible entries received. Potential winner will be selected by a computer generated decision. The computer generated decision, as determined by the game administrator ("Administrator"), shall be final and binding. Potential winner will be notified via mail and/or express mail at the street address provided upon entry into the Sweepstakes. If winner notification is returned as undeliverable without a forwarding address, prize will be forfeited. Except where prohibited by law, the potential winner must sign and return to Administrator, within ten (10) days of the date notice or attempted notice is sent, an affidavit of eligibility and liability/publicity release in order to claim his/her prize and be verified as a winner. If a potential prize winner cannot be contacted or fails to sign and return the affidavit and release or the requested information for themselves within the required time period, or if any prize notification or prize is returned as undeliverable he/she forfeits the prize and no other substitution of the prize or remuneration will be granted. Unclaimed prizes will not be awarded.
  6. Release. By acceptance of any Sweepstakes prize, winner agrees to release and hold harmless Promotional Parties and all of their respective officers, directors, shareholders, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use of any prize. By accepting prize, winner consents to Sponsor use his/her name and likeness in all media now known or hereinafter developed without territorial or time limitation without further payment, except where prohibited by law.
  7. General Conditions. Promotional Parties reserve the right to cancel, suspend and/or modify the Sweepstakes if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor will award the prize in a random drawing from all valid, non-suspect entries received prior to cancellation. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
  8. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, sales representatives accepting the entry, printing errors or by any of the equipment or technology associated with or utilized in the Sweepstakes; (2) unauthorized human intervention in any part of the entry process or the Sweepstakes; (3) technical or human error which may occur in the administration of the Sweepstakes or the acceptance or processing of entries; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use of any prize.
  9. Disputes. This Sweepstakes shall be governed by the laws of California, without respect to conflict of law doctrines. By entering, participating or accepting any prize in this Sweepstakes, you agree that California courts shall have exclusive jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and that venue shall be only in Fresno County, California. Further, in any such dispute, under no circumstance will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, including reasonable attorneys’ fees, other than participants actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes).

  11. Winner's List. For the name of the Sweepstakes winner, send a hand-printed, self-addressed, stamped #10 envelope to: 2009 Grapes from California Sweepstakes Winners List Requests, Tic Toc, Inc., 1999 Bryan St, # 1900, Dallas, TX 75201. Requests must be received by January 15, 2010.
