Official Rules
1. NO PURCHASE OR SALES PRESENTATION NECESSARY. A PURCHASE OR SALES PRESENTATION WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID OUTSIDE U.S. AND CANADA, AND WHERE PROHIBITED BY LAW. SWEEPSTAKES BEGINS 12:00:01 A.M. ET ON OCTOBER 1, 2008, AND ENDS AT 11:59:59 P.M. ET ON NOVEMBER 30, 2008 ("PROMOTION PERIOD").
2. Who May Enter: Sweepstakes only open to legal residents of the 50 United States and Canada who are of the legal age of majority in their state or province of residence. The following persons are NOT eligible to participate: employees and immediate family members (parent, child, sibling and spouse of each) and household members of employees of the California Table Grape Commission ("Sponsor"), the advertising and promotional agencies of Sponsor (collectively the foregoing shall be referred to as "Promotional Parties"). Subject to all federal, state, provincial and local laws and regulations apply. Void outside the U.S. and Canada and where prohibited by law.
3. How to Enter. During the Promotion Period, go online and complete and submit in full an official entry form at the website, http://grapesfromcalifornia-sweepstakes.com/. Entry must be filled out completely and accurately with first and last name, age, daytime telephone number (including area code), street address (no PO boxes, please) and e-mail address. Limit of one entry per person/email address. Any form of entry other than that described herein is void. Sponsor is not responsible for any computer or e-mail failures that may result in lost or garbled entries or which affect the administration of the Sweepstakes. All entries become the property of the Sponsor and will not be acknowledged or returned. Promotional Parties are not responsible for incorrect, lost, late, misdirected, damaged, or incomplete entries. Promotional Parties are not responsible for computer system or transmission line errors, software or hardware malfunctions, or other errors, failures, or delays in transmission that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from downloading or entering any part of this Sweepstakes. Entries will be deemed to have been submitted by the Authorized Account Holder of the e-mail address submitted at time of entry. The "Authorized Account Holder" is the natural person who is assigned the e-mail address by an Internet access provider, online service provider, or other organization (such as a business or educational institution) that is responsible for assigning the e-mail address for the domain associated with the submitted e-mail address. In the event of a dispute over the ownership of an e-mail address, the Authorized Account Holder of the designated e-mail address will be considered the potential winner of any prize. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified.
4. Prize: One (1) Grand Prize: a trip for four (4) to a Los Angeles-area theme park for a family vacation. Prize includes round trip coach class airfare from a major commercial airport near winner's residence to Los Angeles, CA, 4 nights’ hotel accommodations [two (2) rooms, double-occupancy] on or near the park property, park admission for four (4) days, ground transportation, meals and $500 USD spending money (awarded as a check made payable to the winner). Winner and his/her guests are responsible for all travel-related expenses not listed above, including gratuities and incidental room charges. Winner is responsible for obtaining all necessary travel documents, and Sponsor is not responsible for delays in obtaining such documents. Winner must act in a responsible manner and comply with ground rules for conduct at the theme park and/or property; rules will be available/posted, on-site, upon arrival. If winner or any of winner’s guests violate(s) any of the ground rules, breaks any laws, or endangers the his/her own safety or the safety of any other person at the theme park and/or property, as determined by Sponsor or its representatives at their sole discretion, they will not be permitted to remain. No compensation will be given to winner or any of winner’s guests if they are required to leave early. Winner and guests must travel on the same itinerary.
The approximate retail value of the grand prize is $6,500 USD ($6,529 CDN). The actual value may vary depending of point of departure and airfare fluctuations; difference between estimated value and actual value, if any, will not be awarded. Canadian value is based on the exchange rate as of May 15, 2008, and may vary depending on variations in the exchange rate. Prize trip must be taken by August 31, 2009, may be subject to blackout periods and availability at the time of booking.
5. Drawings and Verification of Potential Winner’s Entry. Potential winner will be selected in a random drawing from among all eligible entries received, on or about December 15, 2008, at the offices of the Administrator in Dallas, TX, USA. Potential winners need not be present at the time of the drawing. Odds of winning depend upon the total number of eligible entries received. Potential winner will be selected by a computer generated decision. The computer generated decision, as determined by the game administrator ("Administrator"), shall be final and binding. If the potential winner is a resident of Canada, potential winner must correctly answer a timed mathematical skill question in order to be declared the winner. Potential winner will be notified via mail and/or express mail at the street address provided upon entry into the Sweepstakes. If winner notification is returned as undeliverable without a forwarding address, prize will be forfeited. Except where prohibited by law, the potential winner and his/her guests (or the parent/legal guardian of any guest under the age of majority) must sign and return to Administrator, within fourteen (14) days of the date notice or attempted notice is sent, an affidavit of eligibility and liability/publicity release in order to claim the prize and be verified as a winner. If a potential prize winner cannot be contacted or fails to sign and return the affidavit and release and his/her guests’ signed releases, or the requested information within the required time period, or if any prize notification or prize is returned as undeliverable he/she forfeits the prize and no other substitution of the prize or remuneration will be granted and prize may be awarded to an alternate winner. Unclaimed prizes will not be awarded.
6. Release. By acceptance of any Sweepstakes prize, winner agrees to release and hold harmless Promotional Parties and all of their respective officers, directors, shareholders, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use of any prize. By accepting prize, winner consents to Sponsor’s use of his/her name and likeness in all media now known or hereinafter developed without territorial or time limitation and without further payment, except where prohibited by law.
7. General Conditions. Promotional Parties reserve the right (subject to the approval of the Régie in Quebec) to cancel, suspend and/or modify the Sweepstakes if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In the event of cancellation, Sponsor will award the prize in a random drawing from all valid, non-suspect entries received prior to cancellation. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
8. Limitations of Liability. The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or technology associated with or utilized in the Sweepstakes; (2) unauthorized human intervention in any part of the entry process or the Sweepstakes; (3) technical or human error which may occur in the administration of the Sweepstakes or the acceptance or processing of entries; or (4) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize.
9. Disputes. This Sweepstakes shall be governed by the laws of California, without respect to conflict of law doctrines. By entering, participating or accepting any prize in this Sweepstakes, you agree that California courts shall have exclusive jurisdiction over any dispute or litigation arising from or relating to this Sweepstakes and that venue shall be only in Fresno County, California. Further, in any such dispute, under no circumstance will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, including reasonable attorneys’ fees, other than participants actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes).

11. Winner’s List. For the name of the Sweepstakes winner, send a hand-printed, self-addressed, stamped #10 envelope to: 2008 Grapes from California Sweepstakes Winners List Requests, Tic Toc, 1999 Bryan St, # 1900, Dallas, TX 75201. Canadian residents mail requests to 2008 Grapes from California Sweepstakes Winners List Requests, 33 Bloor St., East, Suite 1500, Toronto, ON M4W 3H1, Canada, Attn: Chantale Carpenter. Requests must be received by January 15, 2009.
12. Quebec Residents. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
